Terms and Conditions of Sale

These Terms apply to the sale of artworks and other items by Pawel Wysocki (“we”, “us”) via our website shop (the “Online Shop”). By placing an order, you agree to these Terms. If you do not agree, do not place an order.

2. Orders and Availability

  • Orders are subject to acceptance. An email acknowledging your order is not confirmation of acceptance.

  • A contract is formed only when we dispatch the goods or confirm they are ready for collection.

  • Descriptions and images are for guidance; actual goods may vary slightly.

  • Prices are as shown on the Online Shop at the time of order, exclusive of delivery charges (unless stated). Errors in pricing will be corrected; you may cancel or reconfirm the order.

3. Payment

  • Payment can be made by debit or credit card via a third-party provider. We do not access your card details.

4. Title and Risk

  • Ownership passes to you on delivery or collection once full payment is received.

  • Risk passes to you upon receipt; you are responsible for loss or damage after this point.

5. Delivery and Collection

  • You may collect goods from [your address]. Failure to collect within 30 days may incur storage fees.

  • Delivery costs depend on location and item size; these are payable by you.

  • We aim to dispatch artworks within 30 days (or as specified). Some items may have longer lead times.

  • You are responsible for import duties, taxes, and customs compliance for cross-border deliveries.

6. Copyright and Use

  • All artworks, editions, and related materials remain the intellectual property of Pawel Wysocki. No copyright or other intellectual property rights are transferred upon purchase. The artist’s moral rights are fully asserted.

  • You may not reproduce, publish, sell, or distribute images of the artwork in any form – whether online, in print, or otherwise – without prior written consent. This includes sharing images for promotional or commercial purposes on websites or social media.

    If you breach these terms, you acknowledge that:

    • Monetary damages alone may not be sufficient to remedy the breach.

    • We may request the removal of any unauthorised images or listings from websites or social media platforms.

    • Legal action may be taken to prevent further unauthorised use.

7. Restrictions on Use

  • Goods sold to consumers are for personal use only. Businesses may use goods internally; resale is prohibited unless agreed in writing.

  • Resale of artworks is prohibited for two years unless first offered back to me at fair market value.

8. Returns and Cancellations

  • You may return unused goods in original condition within 14 days for a refund (excludes custom-framed works and commissions).

  • Delivery costs are generally non-refundable unless the item is defective or damaged.

  • For online purchases, UK consumers may cancel within 14 days under the Consumer Contracts Regulations, subject to the item being returned in good condition at your cost.

  • Refunds will be processed within 14 days of receipt of returned goods or proof of return.

9. Defective or Damaged Items

  • Inspect goods on delivery. Report damage or defects immediately. Retain original packaging.

  • For statutory rights in the UK, you may request repair, replacement, or refund depending on timing and fault.

10. Liability

  • Our liability is limited to the price paid for the goods.

  • We are not liable for delays or defects caused by events beyond our control.

11. Data Protection

  • Personal data will be handled in accordance with our Privacy Policy. Your name and address may be shared with the artist for record-keeping or enforcement of these Terms. Your name and address may be shared with third-party shipping companies solely for the purpose of delivering your order.

12. Governing Law

  • These Terms are governed by English law. Disputes fall under the non-exclusive jurisdiction of the English courts.
